How is child custody determined?


There are a number of factors that are considered in determining custody of a child. Fundamentally, the court decides based on the “best interests of the child”. This decision applies to custody disputes between parents, agencies or third persons. However, in a case of custody disputes between parent(s) and a third person or agency, it is presumed that the best interest of the child is served by awarding the parent(s) custody, unless proven otherwise by the court.
